These Terms & Conditions ("Terms") govern your use of thekishores.in and any services engaged from The Kishores, operated by Himanshu Kishore ("we", "us", "our"), based in Delhi, India. By using our website, contacting us, or engaging our services, you agree to these Terms.

1. Our services

The Kishores provides:

• Performance ad campaigns (Meta, Google, YouTube)
• Video content management (shooting, editing, posting)
• Website design, development and hosting
• Brand identity & design
• Social media management
• SEO, analytics and related digital marketing/automation services

Exact scope, deliverables, timelines and pricing for any engagement are agreed separately in writing (via email, WhatsApp, or a proposal/invoice) before work begins.

2. Getting started

Engagements typically follow: (1) a free discovery call, (2) a written proposal covering scope, timeline and pricing, (3) your written or payment confirmation to proceed, after which we begin work.

3. Pricing & payment

• Pricing is quoted per project/engagement and confirmed in writing before work begins — there are no hidden fees.
• Payments are collected securely online via our payment gateway partner, Razorpay, or via other methods we may agree to (e.g. bank transfer).
• For ongoing/retainer engagements (e.g. monthly ad management, social media management), fees are billed on the agreed recurring cycle (typically monthly), in advance.
• Where third-party costs are involved (e.g. ad spend on Meta/Google), these are separate from our service fees and are payable as agreed — usually billed directly to your ad account or passed through by us.

4. Cancellations & refunds

Our full Cancellation & Refund Policy applies to all engagements. In summary: you may cancel and receive a full refund of fees paid before we begin any work on your project. Once work has started (e.g. campaign setup, video editing, design or development has begun), fees paid are non-refundable, as they represent time and resources already committed.

5. Client responsibilities

• You'll provide timely access, information, assets, approvals and feedback needed for us to deliver the agreed work.
• You're responsible for ensuring any content, brand assets, or claims you ask us to use/publish are lawful and that you have the rights to use them.
• Delays in providing access/feedback on your end may affect agreed timelines.

6. Intellectual property

• Final deliverables (e.g. published website, delivered videos, ad creatives, brand assets) become your property once paid for in full, unless otherwise agreed in writing.
• We retain the right to showcase completed work in our portfolio/marketing, unless you request otherwise in writing.
• Third-party assets we license on your behalf (stock footage, fonts, plugins) remain subject to their own licence terms.

7. Ad campaign results & third-party platforms

While we plan and optimise campaigns in good faith, we cannot guarantee specific results (e.g. exact ROAS, follower counts, rankings), as these depend on factors outside our control, including third-party platform algorithms, market conditions, and your own product/pricing/market fit. We are not responsible for changes made by Meta, Google, YouTube or other platforms to their policies, pricing or algorithms.

8. Limitation of liability

To the extent permitted by law, The Kishores' aggregate liability for any claim arising from our services is limited to the fees paid by you for the specific engagement giving rise to the claim. We are not liable for indirect, incidental or consequential losses (e.g. lost profits).

9. Confidentiality

We treat information you share with us about your business as confidential and will not disclose it to third parties except as needed to deliver the services (e.g. sub-contractors bound by confidentiality) or as required by law.

10. Termination

Either party may terminate an ongoing engagement with reasonable written notice (e.g. 15–30 days for retainer services, as agreed at signup). Fees for work already completed, and any non-refundable portion per our Refund Policy, remain payable.

11. Changes to these Terms

We may update these Terms from time to time; the "Last updated" date above will reflect the latest revision. Continued use of our website or services after changes means you accept the updated Terms.

12. Governing law & jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Delhi, India.
